CoastGolf.co.uk ("we", "us", "our") is the trading name of Coast Golf Ltd. whose postal address is at Coast Golf Ltd., Unit 14728, PO Box 26965, Glasgow, G1 9BW. We are a member of TTA (Travel Trust Association), membership number Q6026.

Your rights and our obligations to you are detailed in these terms and conditions. Please read them with care.

The travel arrangements you see on this website or in our literature are provided by third parties. We do not own, control or operate those third parties or the accommodation, transport, golf facilities or other arrangements that you book through us. All travel arrangements which feature on this website or in any of our literature are sold by us as a principal or as a package, except where we indicate that the travel arrangements are sold by us as an agent (non-package) for the actual suppliers of the travel arrangements.

The booking conditions that apply to your booking will vary depending on the type of golf vacation you decide to purchase. We accept bookings for two types of trips.

a) The first type of break is a "Package Booking", these types of bookings are package holidays and so the provisions and the financial protection requirements of the Package Travel Regulations 1992 will apply. In arranging these bookings, we will act as a principal, meaning your contract will be with us. Sections 1 and 2 of these booking conditions will apply to your booking.

b) The second type of break is a "Non-Package Booking". These types of bookings are for individual components of a trip such as golf OR accommodation OR transport.  In arranging these bookings, we will act as an agent for the principal supplier and arrange for you to enter into a contract with them. Sections 1 and 3 of these booking conditions will apply to your booking

Please read the following booking conditions carefully as you will be bound by them. We recommend that you print off a copy and keep them with your booking confirmation.

Section 1 – Applicable to all bookings with Coast Golf.

1.1Product/Package Accuracy

All practical efforts will be made to ensure the accuracy of the information (including prices) on our website, emails, social media and all other literature and promotional material. Unfortunately inaccuracies sometimes occur, therefore we will confirm the details of your chosen product including the price at the time of booking. All our packages and products are subject to availability and cannot be guaranteed until the time of booking.

1.2 Price & Payment

1.2.1 We reserve the right to change the price of any golf vacation, for any reason, and we will advise you of the current price of the golf vacation before any booking. Any ensuing reduction in prices, for any reason, will not apply to confirmed bookings.

1.2.2 When you make your booking you must pay a deposit per person which you will be informed of at the time of booking. Where your booking is for more than one person, the lead name/person will be responsible for the entire booking. As lead name you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. The lead name will be responsible for making all payments due in accordance with the contract. The lead name is also responsible for keeping all members of the group informed as to the booking details and informing us in writing of any amendments to or cancellations of the booking.

1.2.3 The time limit in which you have to pay is variable and will be notified to you at the time of booking. In some instances, depending upon the lead time between your booking date and commencement date, payment may be due in full at the time of booking. Failure to pay your balance in full by the stated dates will result in the cancellation of your booking and the application of the cancellation charges referred to below in section 2.3.2 & 3.3.2.

1.2.4 The standard deposit required will depend on the golf vacation product you choose. The standard deposit is 50% of the booking value for all vacation packages. Some suppliers will require full payment at the time of booking, and your Coast Golf expert will advise you at the point of booking if your deposit is more than the standard.

1.2.5 Full payment will be required should you book within eight weeks of travel

1.2.6 We accept the following credit/debit cards: Visa, MasterCard, American Express, Switch, and Delta. There is no charge for the use of UK debit cards, however there is a 1.9% transaction charge for all credit cards, except for American Express which carries a 2.8% transaction charge. Payments made online may only be made by debit or credit card. Cheques made payable to ‘Coast Golf Ltd.’ are also accepted as long as we receive them no later than 8 weeks before your travel date. Please clearly write the Coast Golf Booking Reference Number on the back of the cheque.

We take all reasonable care to ensure our website is secure but, unless we have been negligent, we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data you provide when accessing our website.

By entering your payment details, you confirm that the credit or debit card that is being used is yours or that you have been specifically authorised by the owner of the credit or debit card to use it. All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be able to process your booking.

1.2.7 We also accept payment via BACS transfer. Details of the Coast Golf Bank Account are available on request.

1.2.8 Should you erroneously make an on-line over payment on your booking, we  will be refund to you the excess subject to deduction of a handling charge of £5.

1.3 Making a booking

1.3.1 You can make a booking for a Coast Golf vacation by either telephoning our expert sales team on +44 (0) 141 212 0828, sending us an email enquiry about a vacation to ‘info@coastgolf.co.uk’ or using our “ENQUIRE NOW” button on the website. You must be 18 years or over to make a booking and all bookings are subject to availability.

If you send us an enquiry about a break using our “ENQUIRE NOW” button, we will acknowledge receipt of your enquiry as soon as possible and then telephone or email you with availability and any other details you require. If you want to go ahead and book your Coast Golf vacation, we will take payment over the telephone or issue an invoice to you in an email.

1.3.2 After we have received deposit payment from you, we will then email you a booking confirmation, which will set out full details of your booking and show any remaining balance to be paid and the date by which it is due. For all Package Bookings, a contract between you and us will only exist when we issue the booking confirmation by email. For all Non-Package Bookings a contract between you and the supplier (hotel / golf course / transport company) will only exist when we issue the booking confirmation by email. Please check the booking confirmation carefully as soon as you receive it paying special attention to the dates, hotel, room type and tee times. Please contact us within 72 hours of receiving the booking confirmation if any information appearing on the confirmation or any other document appears to be incorrect or incomplete, as it may not be possible to make changes later.

1.5 Insurance

At Coast Golf we believe adequate travel insurance to be essential. We strongly recommend that you purchase golf travel insurance. Some insurance companies may consider the game of golf as a dangerous sport and you should mention your participation when obtaining a quotation. You should also ensure that your golf equipment is covered in the policy.

1.6 Special Requests

Should you have any special requests, please advise us of these at the earliest possible moment prior to booking your vacation if possible. We will do our very best to pass any reasonable requests on to the necessary supplier, however we regret we cannot guarantee any request will be met. Unless explicitly confirmed in writing, all special requests are subject to availability.

If you or any member of your party has any medical issue or disability that may require assistance, please tell us before you book or, if diagnosed after you confirm your booking, as soon as possible after you become aware. If the supplier in question reasonably feels unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline your booking or, if full details are not given at the time of booking, cancel when we become aware of these details.

1.7 Complaints

Should you be unhappy with the product/service that you receive with any hotel, golf course or any other supplier, please communicate this with the supplier as soon as reasonably possible and they will work towards rectifying the issue. If you do not follow this protocol, the supplier and Coast Golf Ltd., will have been unable to investigate your situation while you were on-site and this may affect your rights. If you feel the issue cannot be resolved at the time, please put your complaint in writing to ‘Coast Golf Customer Services, Unit 14728, PO Box 26965, Glasgow, G1 9BW’ within 28 days of the completion of your holiday.

1.8 Force majeure

In the Coast Golf Ltd. booking terms & conditions, the term "force majeure" means any event which we or the supplier could not, even with all due care, predict or anticipate. Such events may include, without limitation, war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, epidemics and pandemics and all similar events outside our or our suppliers’ control. You may wish to purchase specific insurance to cover you for any out of pocket costs associated with a force majeure event.

1.9 data protection & privacy policy

We will store all information responsibly on our secure servers, and will take all reasonable precautions to prevent the loss and misuse of this data.

In order to process your booking we need to use the personal information you provide such as name and address. We take full responsibility for ensuring that proper security measures are in place to protect your information and we will comply with the Data Protection Act 1998. In order to complete your booking we must pass the information on to the relevant suppliers of your travel arrangements such as golf courses, hotels, and transport companies

If we cannot pass your personal information on to the relevant suppliers we cannot complete your booking. By providing us with your personal information, you consent to our use of that data as specified.

NOTE: Coast Golf will comply fully with GDPR (General Data Protection Regulation) & PECR (Privacy & Electronic Communications Regulation) scheduled to come into effect in May 2018.

1.10 Governing law & jurisdiction

All contracts entered into between you and us shall be governed by the law of Scotland. Any dispute arising under or in connection with these Terms and Conditions or any additional / alternative terms brought to your attention in connection with your holiday shall be referred in the first instance to arbitration by a single arbiter appointed by agreement by us and you or, failing agreement, nominated on the application of either party by the President for the time being of the Law Society of Scotland, and the parties agree to be bound by the appointed arbiter’s decision. In the event that the Arbiter is unable to reach a decision in relation to the dispute, or if the Arbiter’s decision is that the dispute should be referred to an alternative body for resolution, or if you request that the dispute be referred directly to the Courts, you and we agree to submit to the non-exclusive jurisdiction of the Scottish Courts.

Section 2 – Applicable to package bookings sold by Coast Golf Ltd.

2.1 Contract

2.1.1 Your contract is with Coast Golf Limited.

2.1.2 All packages we advertise are not an offer by us to sell any package, but an invitation to you to make an offer to us. We are at liberty to accept that offer or to reject it. A contract will exist as soon as we issue our confirmation of booking. Confirmation of booking will be issued upon us receiving your deposit.

2.2 Price & Payment

2.2.1 We reserve the right to change the price of any golf vacation, for any reason, and we will advise you of the current price of the golf vacation before any booking. Any ensuing reduction in prices, for any reason, will not apply to confirmed bookings.

2.3 If you wish to Amend or cancel your booking

2.3.1 If, after confirmation of your booking, you wish to change your booking we will try to arrange this with the relevant supplier, but it will of course be subject to the supplier’s terms and conditions and will also include our administration charge. Furthermore, in any event any request for a change must be made by the person who made the booking - the Lead Contact (see section 1.2.2). You should be aware that changes made to your booking could incur an increase to the cost of your booking and the closer to the start date that changes are made the greater this increase is likely to be. You should contact us as soon as possible if you want to change. Some restrictions beyond our control will prevent any changes from being made prior to the start date of your booking and a loss of all money paid.

2.3.2 If you cancel your booking you will have to pay the cancellation charges of the supplier, and you will also have to pay our administration costs as set out below. Cancellations must be notified to us in writing via letter to our postal address or alternatively by e-mailing info@coastgolf.co.uk.

More than 42 days prior to departure - Loss of full deposit paid plus any additional cancellation charges from your Supplier Principal(s). (Up to 100% of booking value)

41-29 days inclusive prior to departure - £20 administration fee per person plus loss of full deposit paid and any additional cancellations charges from your Supplier Principal(s). (Up to 100% of booking value)

28-0 days inclusive prior to departure – Full value of booking.

2.3.3 If you wish to cancel a singular part of your booking, either a component or a passenger/group member, this may be subject to full cancellation terms as above.

2.4 If we Amend or cancel your booking

Unfortunately, we may have to make changes both before and after bookings have been confirmed, as well as cancel confirmed bookings. Whilst we always endeavour to avoid amending or cancelling a booking, we must reserve the right to do so. However we will not cancel your booking after the Balance Due Date, except for reasons of force majeure (as defined in section 1.8) or failure by you to pay the final balance by the Balance Due Date.

In most cases, changes will be minor and may not impact your overall holiday and we will advise you of them at the earliest possible date. Should we have to make larger changes to your holiday or cancel your holiday, we will offer you one of the below choices:

1. Accept the changes;

2. Purchase an alternative holiday from us. We will try to offer you an alternative holiday of at least equivalent higher standard for which you will not be asked to pay any more than the price of the original holiday. If we are only able to offer you an alternative that is cheaper than the original confirmed holiday, we will refund the price difference;

3. Full cancellation of your holiday, resulting in a full refund.

2.5 Our Liability to you

2.5.1 We are obliged to make sure that the booking arrangements we have agreed to make, perform or provide as part of our contract with you are made, performed or provided with reasonable skill and care.

Should you wish to make a claim that the booking arrangements we have agreed to make, perform or provide have been made, performed or provided without reasonable skill or care it is your responsibility to show that reasonable skill and care has not been used and that your enjoyment of your holiday has been affected. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers).

2.5.2 We shall not be liable to you for any damage caused to you by our failure to perform the contract or our improper performance of the contract if that failure is:

a) attributable to you; or

b) attributable to a third party unconnected with the provision of the holiday, and is unforeseeable or unavoidable; or

c) due to: i) unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if we had exercised all due care; or ii) an event which we or the relevant supplier, even with all due care, could not foresee or forestall.

d) an event of 'force majeure' (see section 1.8)

2.5.3 We will not be liable for any services which do not form part of our contract with you. This includes additional services or facilities provided by our suppliers that we have not arranged for you.

2.5.4 Other than as set out above, we will have no legal liability whatsoever to you for any loss, damage, personal injury or death which you suffer arising directly or indirectly from any aspect of your booking.

2.5.5 If we are found liable to you on any basis, we limit the amount we have to pay you to a maximum of three times the cost of your accommodation. This limit does not apply to cases involving death or injury.

1.5. Financial Protection
1.5.1 All the package bookings we sell come with 100% protection for your money.

Section 3 – Applicable to non-package bookings sold by Coast Golf Ltd.

3.1 Contract

3.1.1 In arranging non-package bookings, Coast Golf will act as an agent for the principal supplier and arrange for you to enter into a contract with the them Your contract is with the supplier.

3.1.2 All non-package bookings which we provide is not an offer by us to sell a non-package booking, but an invitation to you to make an offer to us. We are free to accept that offer or to reject it. A contract exists as soon as we issue our confirmation of booking.

3.3 if you wish to Amend or cancel your booking

3.3.3 If you wish to cancel a singular part of your booking, either a component or a passenger/group member, this may be subject to full cancellation terms as above.

3.4 Amendment or cancellation made by the supplier

Your supplier principal may change or cancel your booking in accordance with its terms and conditions. Should it do so we will let you know as soon as we are aware and your position will depend upon the relevant supplier principal(s) terms and conditions. If the supplier notifies you of any change to your booking directly, it is your responsibility to provide an update to us as soon as reasonably possible.

3.5 our liability to you

Your contract is with the supplier principal(s) and its booking conditions apply. As booking agent, we will not accept responsibility for the provision of the products or services provided by the supplier. Our responsibilities are limited to making the booking in line with your instructions. We also do not accept responsibility for any information about the hotel that we pass on to you in good faith. If we are found liable to you on any basis, we limit the amount we have to pay you to a maximum of three times the cost of your accommodation. This limit does not apply to cases involving death or injury.
